Does the Court Tame the Government?
The Court needs to devise more effective ways to make the government accountable to citizen’s rights.
On the face of it, there is much to praise in the Supreme Court’s order setting up a committee headed by Justice (Retd) R V Raveendran to probe the Pegasus hacking revelations. The order says salutary things about privacy and free speech, especially in the context of the freedom of the press. It acknowledges the depth of research and investigation that has been undertaken by the news agencies that broke the Pegasus story. It brushes aside the clumsy attempt by Solicitor General Tushar Mehta to try and discredit the work. It points out that merely because the union government raises the bogey of “national security,” it does not become immune from judicial scrutiny of its acts.
All of these are some of the nice things the Court “says.” All of these are pleasing to read and have been widely welcomed in the media.
