Vivek is an under-trial prisoner for the last three years. He has been put in Madurai prison after initially being remanded in Cuddalore for a year. His trial is on for the last two years at Periakulam about 80 km from Madurai in Tamil Nadu.

On 14 March 2015, advocate Raja visited Vivek in prison. After the mulakaat (meeting) with the lawyer in the presence of prison officials, at about 12.30 pm, Vivek was returning to his cell when an OCT (officer cadet trainee) team stopped him for screening. The team behaved in an undignified manner, trying to check his underwear. Vivek objected to this and refused to undergo the screening. The OCT special team, deputed to the jail to monitor his activity in jail, shouted at him in foul language for not allowing them to screen him. Vivek contested this.
