Pharmaceuticals Elusive Repayments IT is now two months since the Supreme Court disposed of the stay order granted by several high courts on the government's Drug Price Control Order (DPCO) of 1979. The Supreme Court ruled that the price fixation order was a legislative activity and not subject to judicial review. In essence it reiterated the government's authority to set prices so as to secure bulk drugs for consumers at fair prices. Whatever the larger implications of such an expression of faith in the government on the part of the Supreme Court, it should have prompted the centre to take immediate steps to implement an order which had been bogged down in the courts of law for six years.
