While Madhya Pradesh is an acknowledged leader in implementing the Biological Diversity Act, 2002, operationalising the local-level biodiversity management committees is a continuous challenge. The state’s multipronged approach with a focus on bio-fi nance, regulatory fl exibility, convergence with other government schemes, and enabling policy environment holds the key to building empowered, Atmanirbhar biodiversity management committees.

Relocation from Tiger Reserves under the NTCA Guidelines

Relocation under the National Tiger Conservation Authority Guidelines for Voluntary Village Relocation in Notified Core/Critical Tiger Habitats of 2011, represents a paradigmatic shift from the previous history of displacement from protected areas. About a decade later, this article attempts an overview of the state of relocation under the Guidelines and seeks to throw light on the implementation challenges faced so far.

Government as an ‘Efficient and Responsible’ Litigant

In the light of the growing recognition that government litigation constitutes a big burden on both the judiciary and the government, a Draft National Litigation Policy was formulated in 2010 with the objective to transform the government into an efficient and responsible litigant. Following this, the Government of Madhya Pradesh brought out a State Litigation Policy. In this context, the challenges for the government in realising this goal and the factors responsible for increasing litigation and untenable “causes of action” are examined, with broader relevance for the rest of the country.

Protection of Traditional Knowledge

The new National Intellectual Property Rights Policy advocates an aggressive, neo-liberal agenda of commodification of knowledge, and extends this to traditional knowledge as well. However, there is a need to revisit the primary, still unresolved issues regarding the protection of traditional knowledge and their tentative solutions. Considering the inevitability of participation in the global trade order, a case is made for equipping traditional knowledge holders and indigenous and local communities with the wherewithal to participate in the market economy, proactively assert their rights over their traditional knowledge, and derive benefits from its use.

Draft Guidelines for Safe Handling of Nanomaterials

A look at the draft guidelines on regulation of nanotechnology in India brought out by the Department of Science and Technology through the Nano Mission in the context of the discourse on this subject abroad as well as in India.
